NOTICE OF GENERAL ELECTION
 
To the registered voters of the City of Lake Jackson, Texas:

Notice is hereby given that the polling places listed below will be open from 7:00 a.m. to 7:00 p.m., May 10, 2008 for voting in a general election to elect Mayor and Council positions 2 and 4 of the City of Lake Jackson, Texas and the following Charter Amendments and sale of parkland:

Proposition No. 1
Shall Section 3.01(d) of the Home Rule Charter of the City of Lake Jackson be amended to delete the section that describes how the numbered council positions were originally assigned in 1970?

Proposition No. 2
Shall Section 3.01(g)(1) of the Home Rule Charter of the City of Lake Jackson be amended so that a councilmember who has served three consecutive terms shall be eligible to serve as a councilmember again after not being a councilmember for a period of 18 months rather than 30?

Proposition No. 3
Shall Section 3.01(g)(3) of the Home Rule Charter of the City of Lake Jackson be amended so that a mayor who has served three consecutive terms shall be eligible to serve as mayor or a councilmember again after not being a mayor for 18 months rather than 30?

Proposition No. 4
Shall Section 3.06 of the Home Rule Charter of the City of Lake Jackson be amended so that, if there are two or more vacancies on council, council may appoint qualified replacements within 10 days of such vacancies (except within 60 days of a regular city election or during a run-off election) and so that the unexpired terms of these vacancies shall be filled at the next regular city election?

Proposition No. 5
Shall Section 4.02 of the Home Rule Charter of the City of Lake Jackson be amended so that subsections a, b, c, and d, which established the position, authority, and qualifications for an elected police chief (which was changed to an appointed position in 1962) are removed and so that the police department will continue to be administrated, as it is today, in the same management structure as all other city departments.

Proposition No. 6
Shall Section 4.04(b) of the Home Rule Charter of the City of Lake Jackson be amended so that the judge of municipal court shall be a qualified voter of the State of Texas and be an attorney licensed to practice law in the State of Texas?

Proposition No. 7
Shall Section 4.05 of the Home Rule Charter of the City of Lake Jackson be amended so that the city council may only appoint city attorneys that are licensed to practice law in the State of Texas?

Proposition No. 8
Shall Section 5.04 of the Home Rule Charter of the City of Lake Jackson be amended so that the order in which the names of candidates appear on the ballot shall be determined by the method set by state law?

Proposition No. 9
Shall Section 5.08(b) of the Home Rule Charter of the City of Lake Jackson be amended so that every officer, before taking the oath or affirmation of office, shall file the statement that they have neither given nor received anything of value in exchange for a vote with the office of the City Secretary?

Proposition No. 10
Shall Section 6.07 of the Home Rule Charter of the City of Lake Jackson be amended so that if an officer whose removal is sought by a recall petition refuses to resign, the city council shall hold a recall election on the next uniform election date in May?

Proposition No. 11
Shall Section 6.10 of the Home Rule Charter of the City of Lake Jackson be amended so that no recall petition shall be filed against any elected official within 6 months after being elected and no recall petition shall be filed against any elected official within 6 months after a recall election has been held for that officer?

Proposition No. 12
Shall Section 8.01(b) of the Home Rule Charter of the City of Lake Jackson be amended so that the provisions for platting property within the city limits shall also apply to property in the extra-territorial jurisdiction of the City of Lake Jackson?

Proposition No. 13
Shall Sections 9.06 and 9.07 of the Home Rule Charter of the City of Lake Jackson be amended so that the city council shall fix the time and place for the public hearings on the budget and tax rate at the same meeting and so that the city council shall hold the public hearing on the budget before or on the same date the City Council holds the public hearing on the tax rate?

Proposition No. 14
Shall Section 9.25 of the Home Rule Charter of the City of Lake Jackson be amended so that notice of sale of personal property seized due to delinquent taxes shall be posted in accordance with the requirements of state law?

Proposition No. 15
Shall Section 11.01 of the Home Rule Charter of the City of Lake Jackson be amended so that records of the City shall be open to inspection in accordance with the Texas Freedom of Information Act?

Proposition No. 16
Shall Section 11.01 of the Home Rule Charter of the City of Lake Jackson be amended so that meetings of the city council and boards or commissions appointed by the council are held in accordance with the Texas Open Meetings Act and all minutes of open meetings are kept and shall constitute public records?

Proposition No. 17
Proposition for authorizing the City of Lake Jackson to sell approximately 1.55 acres of unused parkland that is located in the 100 Block of N. Yaupon.

Early voting by personal appearance will begin on April 28, 2008 thru May 2nd between the hours of 8:00 a.m. to 5:00 p.m. and May 3, 2008 between the hours of 7:00 a.m. and 7:00 p.m, May 5, 2008 between the hours of 7:00 a.m. and 7:00 p.m. and ending on May 6, 2008 between the hours of 7:00 a.m. and 7:00 p.m.
